Prince Harry has been branded the "desperate duke" by a TV commentator after suffering a defeat in his High Court privacy case against the publisher of the Daily Mail – a loss that leaves him and fellow claimants facing an "eye‑watering" legal bill running into tens of millions of pounds.
As RadarOnline.com reported, a judge at London's High Court earlier this month comprehensively dismissed claims brought by Harry, singer Elton John and other high‑profile figures that Associated Newspapers Limited (ANL), publisher of the Daily Mail and Mail on Sunday, had engaged in unlawful information‑gathering.

At a subsequent hearing to determine costs, ANL's lawyers revealed the company had incurred almost $46million in legal fees defending the case, and sought an interim payment of nearly $13.5million from the defeated group, who have insurance cover of up to $22million but still face a potential shortfall of many millions.
TalkTV presenter Kevin O'Sullivan seized on the ruling, calling Harry "the dim Duke" and warning he now faces "the grim prospect of a personal bill" which could run well into seven figures in pounds and dollars.
He said: "The dim Duke now faces the grim prospect of a personal Bill adding up to more than two and a half million pounds. That's $3.3million in America and getting on for $5million Aussie dollars. Can he afford it? Can he he-l."
O'Sullivan claimed Harry was hoping Elton John might "pick up the tab," only for that idea to be "extinguished like a candle in the wind."
A media source exclusively told us: "Privately, there is a real worry around Harry's finances. The case wasn't just lost – it was dismissed in a way that leaves the claimants on the hook for a huge proportion of the other side's costs. Insurance softens the blow, but it doesn't cover everything.
"What you're looking at is a gap of many millions that has to be filled somehow. That's why people around Harry are talking about a desperate situation – not because he's broke in the ordinary sense, but because this level of litigation has created a bill almost no individual wants to face."

Another source said: "There was talk in Harry and Meghan's circle about turning to wealthy friends, and Elton's name came up because of their long‑standing connection through Diana and their shared work on HIV and mental health.
"The response, we're told, was very firm – he is not a bank, and he is not going to underwrite Harry's legal crusade against the press.

"This court defeat hasn't just hurt Harry in the pocket. It has strained relationships with some of the people who stood alongside him in bringing the case and leaves him with fewer options if he wants help paying for this chapter of his battle with the media."

Court documents show ANL is seeking costs on an indemnity basis, under which the losing party must cover the publisher's charges without the usual requirement to prove they were proportionate.
Lawyers for Harry and the other claimants have described ANL's costs as "simply extraordinary" and "eye‑watering," arguing the figure far exceeds the approved budget and offering an interim payment of around $11million by late August.
They accept that, following the dismissal of the claims, an order for costs is appropriate – but insist the interim demand and indemnity basis are excessive.

The legal setback adds to a growing list of costly court defeats for Harry.
In 2024, he lost his challenge against the UK government over taxpayer‑funded police protection during visits to Britain, leaving him with a separate legal bill estimated at around $1.4million once his own costs and those of the Home Office are taken into account.
Between the security fight and the Daily Mail case, royal watchers say the Duke has committed millions of pounds to litigation in pursuit of what he has described as "justice" and accountability over press intrusion, even as judges repeatedly reject his claims.
For critics such as O'Sullivan, the latest ruling is evidence that Harry's campaign against sections of the British media has backfired spectacularly.
